To be successful in a medical malpractice or legal malpractice
case, you have to prove that the doctor or lawyer that injured
you "deviated from the standard of care". This is
more than claiming that the professional was just negligent.
This deviation from the standard of care must be more than
a judgment call by the professional. In other words, if the
professional had a choice between accepted ways of doing things,
but the outcome of the situation was just a bad result, then
there is no malpractice. On the other hand, if the professional
did things that should not have been done under the circumstances,
we have the ability to determine whether you have a claim
that can be pursued.
Professional malpractice cases require a high level of dedication,
knowledge and resources. Experts are almost always necessary.
